Acceptance of Terms and Conditions

By using LAGBLASTER (“LAGBLASTER”, “LAGBLASTER LICENSE”), you agree to be bound by these terms and conditions to be stated in below. These terms and conditions take effect immediately on your first use. If you do not agree to any following terms and conditions please do not access LAGBLASTER. If any of the terms or conditions are not met, your account is subject to closure.

IPTP Networks Da Nang Company Limited trading as LAGBLASTER (“LAGBLASTER”, “IPTP Networks”,“we”, “us”, “our”) retains the right to change or augment any or all of the terms and conditions at any time without advance notice or your consent.

Login account

To use LAGBLASTER, it’s required to have a valid login account that has been set up according to LAGBLASTER’s process. Personal information such as your address, email, phone number, and payment will be voluntarily provided via forms on the website.

By giving us your e-mail address, you agree to receive occasional marketing and/or business e-mails. You may opt out of receiving these e-mails at any time by choosing the unsubscribe option located in the e-mail you received. We will not sell or give your e-mail address to anyone else.

Information collection and security

Information provided for using LAGBLASTER will be kept confidential under the Privacy Policy published on the website.

You must be aware and ensure that the information you provide, including but not limited to personal information, address, payment account, etc., must be under your ownership. It means that we will not infringe any rights of a third – party.

To help ensure the safety of your game account or your other accounts, we recommend using a different e-mail and password combination for your LAGBLASTER account login details. We do not share any of your information with anyone else. If any personal information of the user is to be collected, stored or processed by a LAGBLASTER device IT it shall also be regulated by the Privacy policy and/or the applicable law.

Responsibility

LAGBLASTER makes our best effort to ensure maximum up-time and stability of our servers. In no event shall LAGBLASTER, its suppliers or related software developers be liable for any damages including, without limitation, damages for loss of data or profit, loss of a game account arising out of the use or inability to use the LAGBLASTER LICENSE, even if LAGBLASTER has been notified orally or in writing of the possibility of such damage.

LAGBLASTER reserve the right to take security measures and legal action to prevent unauthorized access, modification, disclosure, or destruction of information that causes damage to LAGBLASTER.

LAGBLASTER is eligible to ask you to provide information related to the bank account holder, bank account, e-wallet, or other documents whenever there is any claim or doubt regarding payment with third-party intermediaries (e.g., VNPay).

Usage

Use of LAGBLASTER servers are limited to gameplay, office solution, family use. You may not use them for any malicious activities, downloading files, as a proxy (e.g.web browsing, IRC). You are responsible for your LAGBLASTER account details and may not give out your account details to anyone. LAGBLASTER reserves the right in it’s sole discretion to terminate any users account and use of service for any reason.

To our reasonable control, we always support you to use LAGBLASTER in the best way. You agree that you have read and undertake to comply with all relevant policies listed on website of LAGBLASTER regardless of whether or not they are referenced in these Terms and Conditions. And LAGBLASTER reserves the right to amend, add, create, or remove any its policy in its sole discretion from time to time.

External links

LAGBLASTER has not reviewed all of the sites linked from the LAGBLASTER websites and is not responsible for the contents of any such site. There is a member’s forum which is moderated; however, inappropriate external links may be posted by members and exist until removed by a LAGBLASTER moderator. The inclusion of any link does not imply endorsement by LAGBLASTER. Use of any such linked web site is at the user’s own risk.

LAGBLASTER is not liable for any damage or loss caused by or allegedly caused by, or in connection with your access to or use of such external links.

Prohibited acts

Using LAGBLASTER for the following purposes:

Aiming against any State, country, or territory. Causing harm to national security, and social order and safety. Propagating war and terrorism. Causing hatred and conflicts among ethnic groups and religions.

Propagating, inciting violence, committing lewd and depraved acts, and causing crimes and social evils. Disseminating information that distorts, slanders, and insults the reputation of the organization, honor as well as the dignity of the individual.

Disclosing State secrets, military secrets, issues on security, economy, foreign affairs, and other secrets prescribed by law. Forging organizations or individuals and spreading fake information in order to infringe upon the legitimate rights and interests of organizations and individuals.

Advertising, propagating, buying, and selling prohibited goods and services. Distributing newspapers, literary works, works of art, and publications that are forbidden. Infringing copyright and intellectual property rights of any organization or individual.

Illegally obstructing the provision and access of information, or the provision and use of services on the Internet by organizations and individuals. Other prohibited acts as prescribed by the law.

You also agree that you fully responsible before the law and any damages that occur in the case of use of the LAGBLASTER for the purposes and/or action for violations of the law.

Intellectual Property

Intellectual Property Rights in patents, copyrights, trademarks, domain names, trade secrets, source code, any other intellectual property, and/ or proprietary rights (collectively, “Intellectual Property Rights”) of LAGBLASTER are legally owned by IPTP Networks. It is forbidden to illegally copy and infringe intellectual property rights under the law.

If you believe your copyright-protected work was posted on a LAGBLASTER website without authorization, you may submit a copyright infringement notification. These requests should only be submitted by the copyright owner or an agent authorized to act on the owner’s behalf. If you choose to request removal of content by submitting an infringement notification, please remember that you are initiating a legal process. Do not make false claims. Misuse of this process may result in the suspension of your account or other legal consequences. Please submit copyright infringement notifications to lagblaster@iptp.net, including your contact information, a description of the work that you believe has been infringed, the URL of where the infringing material is located. You must agree to and include the following statement: “I have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.”, and the following statement: “The information in this notification is accurate, and under penalty of perjury, I am the owner, or an agent authorized to act on behalf of the owner, of an exclusive right that is allegedly infringed.” Complete complaints require the physical or electronic signature of the copyright owner or a representative authorized to act on their behalf. To satisfy this requirement, you may type your full legal name to act as your signature at the bottom of your complaint.

Exclusion of liability

Neither Party (LAGBLASTER or user) shall be liable to the other, nor shall it be deemed to be an omission or breach if there is a delay in the completion or performance of any provision of these Terms and Conditions due to of the following causes beyond such party´s reasonable control (such causes, ´Force Majeure Events´), including but not limited to natural disasters, floods, fires, explosions, war, invasions, riots, other civil unrest, embargoes or blockades that come into effect on or after the starting date to use of LAGBLASTER, a national or regional state of emergency, strikes of any government agency, an interruption caused by breaking fiber optic cables, or other events beyond the control of that Party.

LAGBLASTER is provided by the copyright holders and contributors “as is” and any express or implied warranties, including, but not limited to, the implied warranties of merchantability and fitness for a particular purpose are disclaimed. In no event shall the copyright owner or contributors be liable for any direct, indirect, incidental, special, exemplary, or consequantial damages (including, but not limited to, procument of substitute goods or service; loss of use, data, or profit; or business interruption) however caused and on any theory of liability, whether in contract, strict liability, or tort (including negligence or otherwise) arising in any way out of the use of this LAGBLASTER, even if advised of the possibility of such damage.

General provisions

This Terms and Conditions shall be construed and governed by the laws of Vietnam. All dispute arising out of or relating to this Terms and Condition shall be firstly settled through amicable negotiation. If negotiation fails, it shall be referred to and resolved by competent Court of Vietnam.

If any provision of this Terms and Conditions is determined to be invalid or illegal by a Court of competent jurisdiction, the remaining provisions shall remain in full force, binding and enforceable.  The failure or delay of LAGBLASTER to exercise or enforce any right in these terms and conditions does not waive LAGBLASTER’s right to enforce that right.
